1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the website at hardmoneylenderboston.com (the “Site”) and the services offered through it (the “Services”), which are operated by Lead Skills, LLC d/b/a Hard Money Lender of Boston (“we,” “us,” or “our”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

2. Our Role: Lead Generation Service

Hard Money Lender of Boston is a lead-generation service. We connect borrowers with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, underwriting, rates, terms, funding timelines, and loan documents are the responsibility of the participating lender.

3. No Offer or Solicitation

Information presented on the Site is for general informational purposes and does not constitute an offer, solicitation, or commitment to lend. Any rates, timelines, loan amounts, or program descriptions reflect ranges that may be available through participating lenders and are subject to change without notice. Any loan offer you may receive will come directly from a participating lender under that lender's own terms and disclosures.

4. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Services. You agree to provide accurate, current, and complete information when you submit an inquiry and to update it promptly if it changes. Providing false, misleading, or incomplete information may result in your inquiry being rejected and may disqualify you from further use of the Services.

5. Your Consent to Be Contacted

By submitting the contact form with the “Consent to Contact” box checked, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply, and message frequency varies. You may opt out at any time by replying STOP to any text message or by calling 617-936-7931. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Lender of Boston connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Submit false, inaccurate, or misleading information.
• Use the Site or Services in violation of any applicable law or regulation.
• Access the Site through automated means, scrape content, or interfere with its operation.
• Attempt to gain unauthorized access to any account, system, or data.
• Use the Site or Services to harass, defraud, or harm any person or entity.

8. Intellectual Property

The Site and its content, including text, graphics, logos, images, and software, are owned by Lead Skills, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from Site content without our prior written consent, except as expressly permitted by these Terms or applicable law.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services, including participating lenders. We do not control, endorse, or assume responsibility for the content, policies, or practices of any third party. Your interactions with third parties, including participating lenders, are governed by the terms and privacy practices of those third parties. We are not a party to any transaction or agreement between you and a participating lender.

10. Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, THAT YOU WILL BE MATCHED WITH A PARTICIPATING LENDER, OR THAT YOU WILL RECEIVE A LOAN OFFER.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site or Services, your submitted information, your breach of these Terms, or your violation of any law or the rights of any third party.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be communicated through prominent notice on the Site. Your continued use of the Site or Services after an update constitutes your acceptance of the revised Terms.
